劳动安全问题的现状及法律对策

摘要：劳动安全是生产经营活动中的永恒主题。劳动安全问题是经济建设中必然会遇到，也必须妥善解决的问题。尽管我国党和国家高度重视劳动安全问题，并为此采取了一系列行政的、经济的和法律的措施，也确实取得了较好的效果。但从总体上讲，劳动安全形势十分严峻，重大生产安全事故时有发生，严重威胁和影响着劳动者的生命安全与身体健康，也严重影响着经济建设与社会稳定。为妥善地解决这一问题，本文进行了积极有益的探索，认为劳动安全形势严峻的主要原因是劳动安全问题在立法上存在着空白和矛盾，在执法上存在着严重不足，尤其是一些生产经营单位的负责人或业主不重视劳动安全，不认真落实安全生产责任制，而劳动者又缺乏安全意识与安全技能。进而提出了应对措施，即要按照依法治国方略，建立起一套完整的劳动安全方面的法律体系，并要强化这些法律规范的实施，使劳动安全问题真正得到落实，从而达到劳动安全形势的根本好转。关键词: 劳动安全问题现状法律对策 Abstract : Labor safety is the eternal theme in the manufacturing and managing fields. The issue of labor safety can not be avoided in the development of economy, so it should be solved properly. Although the Party and the government have placed high importance on the issue, adopted a series of administrative, economic and legal measures and achieved some comparatively good effect, the situation remains severe as a whole. Big accidents during producing happen occasionally, which not only strongly threatens and affects the security and health of the workers, but also harms the economic development and social stability. In order to solve the problem properly, the thesis is written on the basis of a vigorous and beneficial exploration. It is put forward in the thesis that the cause of the severe situation in labor safety lies mainly in the gaps and conflicts of legislating, the serious weakness of executing and especially some leading cadres and proprietors, who don’t attach importance to labor safety or put the system of job responsibility regarding safe production into effect and some workers who are short of safety awareness and skills. So appropriate measures are provided in the thesis. In accordance with the general plan of running the country by the rule of law, we should establish a complete legal system governing the labor safety, strengthen the execution so as to truly carry out the measures and fundamentally make the situation take a favorable turn. 关键词: Labor safety, Problems, Situation, Legislative measures
